The minor plaintiff born Nov. 18,1989, suffered from an elevated lead level in April 1991 of 12 Pb and 37 EP.

Subsequently the child was removed from the lead environment and the elevated lead level subsided. The settlement was effectuated after a complaint had been filed but before there had been service of process on defendant or an answer filed on defendant's behalf. It was the intent of plaintiff to introduce evidence in this civil action on the effects of low levels of lead as set forth in the new CDC guidelines of October 1991.

As is the usual practice of Rainer & Rainer, a percentage of the attomeys' fees from this settlement is being donated to abcd, a non profit, anti-poverty agency for use in the Model Lead Abatement Project which provides funds for deleading to low income families.
